The Achmea case marks the end of intra-EU investment arbitrations due to their incompatibility with EU law. The exact scope of the decision was, however, heavily debated and many questions remained unresolved. Recently, the ECJ tackled some of these questions in cases PL Holdings, Komstroy, and European Food.
