title = "Die partizipative L{\"u}cke im {\"o}sterreichischen Mandatsverfahren: Handlungswissen und Einstellungen bei Akteuren der Strafverfolgung",
abstract = "his article aims to present a legal-linguistic perspective on the lin-guisticconstruction of professionals and non-professionals, and to reflect on such constructions in relation to the assumed remoteness of criminal procedur-al law. These aspects will be considered and exemplified by reference to the Austrian mandate procedure. While the written word is the most important medium of legal discourse, the main hearing fulfils a variety of different func-tions in criminal procedural law, all of which aim to realize the right to a fair trial (Art. 6 ECHR) and to compensate for any potential power asymmetries between non-professionals and law enforcement agencies. On the basis of an analysis of five interviews with professionals, this article describes and discuss-es procedural knowledge of and attitudes towards verbalisation in criminal law discourse.",
