Abstract

Personal credit securities are gaining importance in the face of geopolitical and economic challenges, particularly the war in Ukraine and the associated sanctions. The text comprehensively examines the legal framework and practice of suretyship and independent guarantees in Russia, while also highlighting differences compared to Austrian and German law. Special emphasis is placed on formal requirements, liability, objections, and their role in insolvency proceedings. Finally, the significance and development of the independent guarantee as a non-accessory credit security, which is increasingly gaining relevance, are discussed.
