Description

The ECJ decisions in the cases Centros, Überseering und Inspire Art have initiated regulatory competition between the corporate law systems of EU and EEA Member States. This project investigates the potential effects of regulatory competition in Europe from the perspective of the economic theory of corporate law. In doing so, it draws heavily on the American literature, which discusses whether regulatory competition between the laws of different US states has led to a race to the bottom or to the top. The results of the project will be published in a series of articles.
